Legal Nature of Compensation for Infringement of an Exclusive Right

Abstract

This article examines the legal nature of compensation as a measure of civil liability for the infringement of exclusive right. Since its inception this institution has remained a subject of doctrinal debate, with scholars disagreeing on its substantive characteristics, its relationship to damages, and its functions. The discussion acquires renewed practical and theoretical significance in the light of the recent introduction of Article 1252.1 into the Civil Code of the Russian Federation in 2025, which established specific statutory rules governing compensation.
