The Civilizational Dimension of Domestic Civil Law

This article examines the development of the law of obligations as an element of Russia's civilizational development (limited to the pre-revolutionary period). An analysis of legal sources demonstrates that, during the pre‑imperial period, translated Byzantine legal acts were fundamental in the sphere of contractual regulation, the subsequent rejection of which led to significant problems. A distinctive feature of Russian law of obligations was the developed system of official liability in the pre-Petrine era and, throughout its pre-revolutionary development, the rejection of the concept of no-fault liability. The article also presents an analysis of customary peasant contract and tort law of the 19th century.
