The Legal Personality of Artificial Intelligence from the Perspective of the Economic Analysis of Law

In the context of the implementation of the National Strategy for the Development of Artificial Intelligence (AI) until 2030, determining the legal personality of artificial intelligence systems has become one of the key legal problems. The article analyzes the prospect of granting AI the status of an “electronic person”, drawing a parallel with the historically established concept of a legal entity. The author examines this issue not from an anthropocentric perspective, but through the lens of the economic analysis of law, exploring the goals and conditions for such a step. It is argued that legal personality is a regulatory tool, and its granting to AI is possible upon achieving a sufficient level of decision-making autonomy and should be economically feasible, contributing to the growth of prosperity and attracting investments. This should be accompanied by the simultaneous creation of compensation mechanisms to minimize potential risks and protect the rights of third parties.
